On May 28, 2024, Governor DeSantis signed HB 481 into law. Effective July 1, 2024, it is an important law related to the automatic transfer of any AC warranty when a property is sold, it includes the following provisions:
- Automatic Warranty Transfer: HVAC system warranties automatically transfer to new owners when residential property changes hands.
- No Transfer Fees: Warrantors cannot charge a fee for warranty transfers and must honor original warranty terms.
- No Registration Requirement: HVAC warranties cannot be conditioned upon product registration.
- Installation Date Coverage: Warranties are effective from the installation date if installed by a licensed contractor.
- Registration Card Information: If provided, the registration card must state:
- It is for product registration.
- Non-completion does not affect warranty rights or duration.
- Warranty conditions cannot require product registration.
Manufacturers, distributors, or retailers cannot require product registration for an HVAC system warranty. If a contractor insists you must register to get the warranty, they’re not being truthful. This is not good practice, so seek a second quote from another contractor.
